If you are unable to pay your bills and would like to speak with a lawyer about filing bankruptcy, it is best to talk with an attorney early in the process. The specifics of your situation will determine what type of relief or debt forgiveness you may be eligible to receive from the court.

At Blais Cunningham & Crowe Chester, LLP, our Rhode Island bankruptcy attorneys provide individuals throughout Rhode Island with representation in Chapter 7 bankruptcy cases.

Frequently Asked Questions About Chapter 7 Bankruptcy in Rhode Island

Chapter 7 bankruptcy is sometimes called "clean slate" or "liquidation" bankruptcy because in many cases a debtor is released of his or her obligation to pay anything toward outstanding bills.

What happens to debt collection when you file for bankruptcy?

  • When you work with an experienced Rhode Island bankruptcy lawyer, we will contact all creditors and notify them that they must immediately stop direct contact with you. Under the law, they are not allowed to call your place of employment or your home — all calls and letters will be sent to your attorney. When you have filed for bankruptcy all collection efforts must stop, including lawsuits, garnishments, repossession actions, foreclosure of mortgages, and demand letters.

Can all debts be discharged in bankruptcy?

  • No. Only certain types of unsecured debt may be completely discharged through Chapter 7 bankruptcy. This generally includes credit card debt, medical bills, and cash advances. For secured debts such as car loans and mortgages, the debtor will usually have to work out a payment plan or liquidate (sell) the property.

Can I get rid of student loan debt in bankruptcy?

  • No, except in very limited circumstances. The vast majority of student loan debts must still be repaid after bankruptcy. It may, however, become easier to make these payments when you no longer have payments for other debts. Other debts that cannot be discharged include alimony, child support, some taxes, and some judgments.

What can I keep after bankruptcy?

  • You will be able to keep most personal property, a vehicle, tools you use to make a living, and some other exempt items.

What happens to my credit rating after bankruptcy?

  • When a person is facing bankruptcy his or her credit is not usually in great shape. In some cases, a person's credit rating actually improves after filing a Chapter 7 bankruptcy.
