If you are just starting negotiations for a rental space you may be wondering how much of your agreement needs to be put into writing. As experienced Rhode Island landlord-tenant attorneys, we know that many cases could have been avoided and interests protected with a properly drafted and well-thought-out contract.
When the relationship between a landlord and tenant sours and it becomes necessary to file an eviction action, the process that must be followed is controlled by state law. The law is very specific as to when notice must be given, the number of days before a hearing, and the reasons for the termination of the lease agreement.
When a landlord proceeds on his or her own, there is considerable risk that the necessary legal requirements will not be followed. Failure to strictly follow the statutory requirements can create additional liabilities for landlords. For example, those who own property as an LLC are often tempted to represent themselves in court. This is a common error made by landlords. An LLC is a separate legal entity and therefore a licensed attorney must represent it when the organization brings or defends actions in court.
